Agreement to these terms
By accessing or using the BlehBinary website, creating an account, or submitting a project request, you agree to be bound by these Terms of Service. If you do not agree, do not use the website or services.
What we provide
BlehBinary provides system administration, Discord and Telegram bot development, and custom software development services. Project requests submitted through the website are inquiries only; they do not create a binding contract. Scope, deliverables, timeline, pricing, and payment terms are agreed separately in writing before any work begins. We may decline any request at our discretion.
Accounts and registration
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity conducted through your account. You must notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to the service or other users.
Acceptable use
You agree not to use the website or services to:
- violate any applicable law or regulation;
- infringe the intellectual property or privacy rights of others;
- transmit malware, attempt to gain unauthorized access, or interfere with the operation of the website;
- harass, threaten, or harm other users;
- build, distribute, or support software that harms others or violates the rules of third-party platforms (including Discord and Telegram).
We reserve the right to refuse or cancel any project that violates these rules.
Intellectual property
BlehBinary retains exclusive rights (copyright) to all source code created within a project. The customer is granted a perpetual, non-exclusive, non-transferable license to use, modify, and commercially exploit the code within their project, subject to the following conditions. The license covers all source code delivered to the customer as part of the project, including any common libraries and templates used in it; ownership of those libraries and templates as such remains with BlehBinary (see P8.7).
Customer obligations (K):
- K8.1 - The customer may not sell, transfer to third parties, or publicly distribute (“leak”) the source code during the warranty period. Violation is a material breach of these terms and results in license revocation (see P8.8) and refusal of service on future orders.
- K8.2 - The customer may edit, customize, and use the code for personal and/or commercial purposes within their project.
- K8.6 - The customer may not remove or hide BlehBinary copyright notices in the source code, if present.
- K8.10 - The customer may not sell, transfer to third parties, or publicly distribute (“leak”) the source code at any time — during or after the warranty period — unless agreed in writing with BlehBinary.
BlehBinary obligations (P):
- P8.3 - BlehBinary may not prohibit use without a justified reason. Justified reasons are: violation of the ToS; violation of the contract; non-payment or partial payment; use of the code to harm third parties; use in violation of applicable law; violation of K8.1; violation of K8.6; violation of K8.10; use in projects that violate the rules of Discord, Telegram, or other platforms.
- P8.4 - BlehBinary may not demand additional payment if the work has already been paid for and the extra charge is not justified by the customer’s needs (example: the customer forgot to check an additional service when ordering - this is a correction within the agreed scope, not a basis for an extra charge).
- P8.5 - BlehBinary does not embed malicious code into customer products.
General provisions:
- P8.7 - BlehBinary reserves the right to reuse common libraries, templates, and approaches developed within a project in other projects.
- P8.8 - If the customer violates any K clause, BlehBinary may revoke the license and demand that use of the code stops.
- P8.9 - If a BlehBinary representative violates any P clause, the customer may file a complaint with the higher management through a support ticket or by emailing [email protected].
All other content on the website - text, design, graphics, logos - is owned by BlehBinary or its licensors and is protected by applicable law.
Warranty
BlehBinary provides a 16 (sixteen) calendar-day warranty on the delivered result, starting at the moment a BlehBinary representative sends the project files to the customer in the order chat or by another agreed delivery method. During this period BlehBinary will fix, free of charge, errors and defects caused by BlehBinary.
The warranty is void if: the source code was modified by the customer or third parties; third-party plugins, libraries, or integrations not agreed with BlehBinary were used; the error arose from changes in third-party services (Discord API, Telegram API, hosting, payment providers); the operating conditions specified in the documentation or contract were violated.
The warranty does not cover new features, changes to requirements after delivery, customer staff training, or consultations regarding third-party products.
Payment and refunds
Payment is made only through the methods shown in the order chat (SBP for RUB, USDT for USD/international). Payment is confirmed manually by BlehBinary after receipt. Work starts after payment is confirmed.
If the customer cancels the project after the first payment, the paid amount is retained by BlehBinary as compensation for the work actually performed and is non-refundable.
Force majeure
We are not liable for failures or delays in performance caused by events beyond our reasonable control, including changes to third-party APIs (Discord, Telegram), hosting or payment provider outages, internet failures, and acts of government. If such an event prevents delivery, deadlines are extended accordingly; if it continues for more than 30 days, either party may cancel the affected order without penalty, and compensation for work already performed remains with BlehBinary.
Disclaimer of warranties
The website and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
Limitation of liability
To the maximum extent permitted by law, BlehBinary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunity, arising from your use of the website or services. Our total liability shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless BlehBinary, its team, and its partners from any claims, damages, losses, or expenses arising from your use of the website, your violation of these terms, or your violation of any third-party rights.
Data and privacy
Our collection and use of personal data are described in our Privacy Policy, which forms part of these terms. By using the website, you consent to that processing.
Termination
We may suspend or terminate your access to the website at any time, with prior notice, if you violate these terms or if we discontinue the service. You may stop using the website at any time. Provisions that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability, and indemnification - remain in effect.
Governing law and disputes
These terms are governed by the laws of the jurisdiction specified for the operator in the header of this page, without regard to conflict-of-law rules. Any dispute arising from these terms or the website shall be resolved in the courts of that jurisdiction, unless mandatory consumer protection laws in your country provide otherwise.
Changes to these terms
We may update these terms from time to time. The current version is always available on this page, with an effective date shown. Continued use of the website after changes means you accept the updated terms.
